CONSTITUTION OF UKRAINE

Article 26. Foreigners and stateless persons who are in Ukraine on legal grounds have the same rights and freedoms and also bear the same responsibilities as citizens of Ukraine - with the exceptions established by the Constitution, laws or international treaties of Ukraine.
Article 33. Everyone who is lawfully within the territory of Ukraine is guaranteed freedom of movement, free choice of residence, the right to freely leave the territory of Ukraine, with the exception of restrictions established by law.
LAW OF UKRAINE
"On the Legal Status of Foreigners and Stateless Persons"
Article 2. Basis of the legal status of foreigners and stateless persons Foreigners and stateless persons have the same rights and freedoms and fulfill the same obligations as citizens of Ukraine, unless otherwise stipulated by the Constitution, this and other laws of Ukraine and international treaties of Ukraine.
Foreigners and stateless persons are equal before the law regardless of origin, social status, wealth, race, national origin, sex, language, religion, gender or occupation, or other circumstances. If a foreign country with restrictions of the rights and freedoms of citizens of Ukraine, Cabinet of Ministers may decide to establish the appropriate order of the rights and freedoms of citizens of this state on the territory of Ukraine. This decision shall enter into force upon its publication. It may be withdrawn if the grounds no longer exist, for which it was made. Implementation of the foreigners of their rights and freedoms should not harm the national interests of Ukraine, rights, freedoms and legitimate interests of its citizens and others who live in Ukraine. Foreigners and stateless persons are obliged to respect and uphold the Constitution and laws of Ukraine to respect the traditions and customs of the people of Ukraine.
SECTION II
FUNDAMENTAL RIGHTS, FREEDOMS AND DUTIES OF FOREIGNERS
Article 14. Right to education
Foreigners and stateless persons who permanently reside in Ukraine, have the right to education as a citizens of Ukraine. All other foreigners pay for their education, unless otherwise stipulated by the legislation of Ukraine and international treaties of Ukraine. Foreigners and persons without citizenship, adopted in educational institutions of Ukraine, have rights and responsibilities of pupils and students in accordance with Ukrainian legislation.
Article 16. The right to participate in associations of citizens Foreigners and stateless persons who permanently reside in Ukraine, have the right to engage in common with the citizens of Ukraine in the grounds of legalized citizen groups, unless otherwise provided by laws of Ukraine and, if required by the statutes of the association. Foreigners and stateless persons may not be members of political parties in Ukraine
Article 17. The right to freedom of conscience
Foreigners have the right to freedom of conscience as citizens of Ukraine. Prohibited from inciting religious hatred and enmity, as well as breach of the Ukrainian citizens and foreigners and stateless persons in connection with their religious beliefs.
Article 19. Guarantees of personal rights
Legislation of Ukraine to foreigners and stateless persons are guaranteed the inviolability of persons, housing, non-interference in private and family life, correspondence, telephone conversations and telegraphic communications, and respect for their dignity as citizens of Ukraine.
Article 20. Movement in Ukraine and residence
Foreigners and stateless persons may travel on the territory of Ukraine and to elect domicile in it in accordance with procedures established by the Cabinet of Ministers of Ukraine. The restriction on movement and residence are permitted, if it is necessary to ensure the security of Ukraine, public order, health, rights and lawful interests of its citizens and others who live in Ukraine.
Article 22. Protecting the rights of foreigners and stateless persons
Foreigners and stateless persons have the right to petition the court and other government agencies to protect their personal, property and other rights. In Proceedings foreigners as participants enjoy the same procedural rights as citizens of Ukraine.
SECTION III. ENTRY TO UKRAINE AND DEPARTURE FROM UKRAINE
Article 25. Entry into Ukraine
Foreigners and stateless persons may enter into Ukraine on true passport documents. At the same time, foreigners and stateless persons must obtain a visa in the established order, unless otherwise stipulated by the legislation of Ukraine.
Entry into Ukraine foreigners and stateless persons may not:
- in the interests of Ukraine's security or public order;
- if it is necessary for health, rights and lawful interests of citizens of Ukraine and other persons who live in Ukraine;
- if in violation of applying for entry to Ukraine, he/ she knowingly gave false information or forged documents;
- if the passport document, the visa are fake, damaged or do not meet the established pattern or belong to another person;
- if at a checkpoint at the border of Ukraine he/ she broke the rules of crossing the Ukrainian border, customs regulations, sanitary norms or rules, or failed to comply with the legal requirements of officers of the State Border of Ukraine, Customs and other agencies that monitor the state border;
- if the facts of violation of the laws of Ukraine during the previous stay in Ukraine.
Article 26. Departure from Ukraine
Foreigners and stateless persons who travel from Ukraine with true passport documents. Foreigners and stateless persons who are granted refugee status in Ukraine, have equal rights with citizens of Ukraine the right to freedom of leaving the territory of Ukraine, with the exception of restrictions established by law.
Departure from Ukraine foreigners and stateless persons are not permitted if:
- he/ she is under inquiry or preliminary investigation or a criminal case is pending trial – until the end of the case;
- he/ she has been convicted of a crime – to serve the sentence or dismissal of punishment;
- his/ her departure is contrary to the interests of Ukraine security – before the termination of the circumstances that prevent his/ her departure.
Departure from Ukraine for foreigners and stateless persons may be postponed until the performance of pecuniary obligations to individuals and legal entities in Ukraine.
CHAPTER IV.
RESPONSIBILITY OF FOREIGNERS
Article 29. Basis of liability for an offense
Foreigners and stateless persons who have committed crimes, administrative or other offense, shall be liable on general grounds.
Article 30. Responsibility for violation of the stay in Ukraine for transit through its territory
For violation of the established order of foreigners staying in Ukraine, that is, living without documents on the right of residence in Ukraine or residence with invalid documents, failure to comply with the established order of registration or of movement and residence, employment, failure to depart after the expiration of stay, as well as for non-compliance transit through the territory of Ukraine are subjected to measures in accordance with Ukrainian legislation.
Article 31. Reducing the period of temporary stay in Ukraine
An alien who violates the laws of Ukraine, if these violations do not include administrative or criminal liability, may be reduced if he/ she stays in Ukraine. This period can also be reduced if a foreigner or stateless persons have ceased to exist grounds for his/ her further stay in Ukraine. The decision to reduce the period of temporary stay of foreigners and stateless persons in Ukraine is made by the Internal Affairs, the State Border Service of Ukraine.
